Acceptable Use Policy
This acceptable use policy is part of the Terms of Use, and capitalized terms used but not defined herein have the meanings given to them in the Terms of Use.
1. Restrictions on Posting Content
1.1 You agree not to Post Content that:
- is unlawful, harmful, threatening, abusive, harassing, defamatory, libelous, invasive of another’s right of privacy or publicity, bigoted, hateful, discriminatory, racially or otherwise offensive, violent, vulgar, obscene, pornographic or otherwise sexually explicit, harmful to minors in any way, or otherwise harms or can reasonably be expected to harm any person or entity;
- harasses, degrades, intimidates or is hateful toward an individual or group of individuals on the basis of religion, gender, sexual orientation, race, ethnicity, age, or disability;
- includes personal or identifying information about another person without that person’s express written consent;
- includes or discloses any individually identifiable health information about you or another person that would require compliance with the Health Insurance Portability and Accountability Act of 1996 (HIPAA) or any similar state law;
- is illegal or encourages or advocates illegal activity or the discussion of illegal activities with the intent to commit them, including any Content that is, involves, or otherwise represents an attempt to engage in, the production or distribution of child pornography, stalking, sexual assault, fraud, trafficking in obscene or stolen material, drug dealing and/or drug abuse, harassment, theft, or conspiracy to commit any criminal activity;
- infringes any patent, trademark, trade secret, copyright or other proprietary rights of any person or entity, or is Content that you do not have a right to make available under any law or pursuant to any contractual or fiduciary relationships;
- involves a contest, giveaway, or sweepstakes (unless you have our prior written consent);
- contains a virus or other malicious code, or otherwise tampers with, impairs or damages any computer software or hardware or telecommunications equipment, or otherwise interferes with any person or entity’s use or enjoyment of the Network;
- could disable, overburden, or impair the proper working of the Network (such as a denial of service attack), or otherwise negatively affects another person or entity’s ability to use the Network;
- employs misleading email addresses, forged headers or otherwise manipulated identifiers in order to disguise its origin;
- constitutes or contains any “affiliate marketing,” “link referral code,” “junk mail,” “spam,” “chain letters,” “pyramid schemes,” or unsolicited commercial advertisements;
- facilitates or encourages any violations of the Terms of Use; or
- advertises any illegal service or the sale of any items the sale of which is prohibited or restricted by any applicable law, including, without limitation, items the sale of which is prohibited or regulated by Tennessee or federal law.
2. Restrictions on Goods and Services
2.1 You agree not to:
- provide false, misleading or otherwise inaccurate information when you describe your skills, degrees, qualifications, background, Products, Services or other information;
- fail to deliver Products purchased from you or fail to honor the pricing or other terms you set for your transactions with Members;
- misrepresent yourself or create a misleading name or listing;
- manipulate the price of any item or interfere with other users’ listings;
- circumvent or manipulate the fee structure or billing process, or fees owed (including by classifying a Product as a Service (or vice versa), or charging a tax rate or shipping rate higher than the applicable rate);
- post any Content containing any paid advertisements or links to our competitors; or
- use, display, or share a Member’s data in a manner inconsistent with their privacy settings.
2.2 You are responsible for complying with all applicable laws, regulations or restrictions that may apply to your Services and/or Products. Before offering or purchasing Services or Products, we encourage you to research the applicable laws and regulations that may apply to make sure they are allowed. The following is a list of some of the types of Services which are not permitted on or through the Network:
- any legal information unless you are a licensed professional in good standing in your relevant field of expertise;
- any advice, directly or through writings, as to the value of securities or as to the advisability of investing in, purchasing or selling securities or any report or analysis concerning securities;
- any advice or any services related to or claiming success with lottery numbers;
- any medical advice or any services that would cause HIPAA to apply, including any that involve individually identifiable health information; or
- offers or solicitations of illegal prostitution.
The following is a list of some of the types of Products which are not permitted on or through the Network:
- obscene material or child pornography;
- weapons and related items, including, but not limited to, firearms, disguised, undetectable or switchblade knives, martial arts weapons, scopes, silencers, ammunition, ammunition magazines, BB guns, tear gas and stun guns;
- items issued to United States Armed Forces that have not been disposed of in accordance with Department of Defense demilitarization policies;
- fireworks or any destructive devices or explosives;
- controlled substances or illegal drugs, substances and items used to manufacture controlled substances and drug paraphernalia;
- alcohol or tobacco products;
- prescription drugs and medical devices, including, but not limited to, prescription or contact lenses, defibrillators, hypodermic needles or hearing aids;
- nonprescription drugs that make false or misleading treatment claims or treatment claims that require FDA approval;
- blood, bodily fluids or body parts;
- goods that would cause HIPAA to apply, including, but not limited to, electronic health records, personal health records, or any electronic records of yourself or of any individual that include personally identifiable health information; or
- goods related to or claiming success with lottery numbers;
- household pets of any kind, including, but not limited to, dogs, cats, primates, cage birds, rodents, reptiles, amphibians and fish;
- pet animal parts, blood, or fluids, including, but not limited to, stud/breeding services;
- restricted or regulated plants and insects, including, but not limited to, noxious weeds, endangered plant species, or live insects or pests;
- pesticides or hazardous substances, or items containing hazardous substances, including, but not limited to, contaminated toys, or art or craft material containing toxic substances without a warning label;
- illegal telecommunications equipment, including, but not limited to, access cards, password sniffers, access card programmers and unloopers or cable descramblers;
- stolen property, or property with serial number removed or altered;
- burglary tools, including, but not limited to, lock-picks or motor vehicle master keys;
- false identification cards, items with police insignia, citizenship documents, or birth certificates;
- counterfeit currency, coins and stamps, tickets, as well as equipment designed to make them;
- counterfeit, replica, or knock-off brand name goods;
- material that infringes copyright, including, but not limited to, software or other digital goods you are not authorized to sell;
- airline tickets that restrict transfer, and tickets of any kind which you are not authorized to sell;
- coupons or gift cards that restrict transfer, and coupons or gift cards which you are not authorized to sell;
- gambling items, including, but not limited to, lottery tickets, sports trading card “grab bags”, raffle tickets, sweepstakes entries or slot machines;
- used or rebuilt batteries, or batteries containing mercury;
- used bedding and clothing, unless sanitized in accordance with law;
- non-packaged food items or adulterated food; or
- bulk email or mailing lists that contain names, addresses, phone numbers, or other personal identifying information.
